Terms of Service

1. About these Terms

These Terms of Service are also referred to as our Terms and Conditions.

Artist Archive is a mobile app designed to help makeup artists, hairstylists and hair and makeup artists organise records relating to their clients, consultations, trials, appointments, products, notes and photographs.

In these Terms:

These Terms form a legal agreement between you and Artist Archive and govern your access to and use of the app.

Our Privacy Policy applies alongside these Terms and explains how personal information is collected, stored, used and protected.

By creating an account, selecting an option indicating acceptance or using the app, you agree to these Terms.

If you do not agree to these Terms, you must not create an account or use the app.

2. Who may use Artist Archive

Artist Archive is a professional record-keeping tool intended for makeup artists, hairstylists and people working in related beauty-service roles.

You must be at least 18 years old to create an account.

By creating an account, you confirm that:

You may not create an account on behalf of another person unless you have their authority to do so.

3. Your account

You are responsible for maintaining the security of your account.

You are responsible for activity carried out through your account unless that activity resulted from a security failure for which Artist Archive is legally responsible.

4. Your right to use the app

Subject to these Terms, Artist Archive grants you a limited, personal, non-exclusive, non-transferable and revocable licence to download, access and use the app for your own professional or business purposes.

This licence allows you to use Artist Archive’s features as made available to your account.

It does not give you ownership of:

Your right to use the app ends when your account is deleted or closed or when these Terms otherwise end.

5. Acceptable use

You must use Artist Archive lawfully and responsibly.

6. Your content

You retain ownership of your content.

Artist Archive does not claim ownership of the client records, notes, products, photographs or other information you enter into the app.

To provide the service, you grant Artist Archive a limited, worldwide and royalty-free licence to:

This permission exists only for the purpose of operating, maintaining, securing and providing Artist Archive and ends when the content is deleted from our active systems, subject to limited backup, legal and security retention described in our Privacy Policy.

Artist Archive does not sell your content.

Artist Archive keeps anonymous counts of how often products appear across the app, as described in section 3.9 of our Privacy Policy. These counts record the product, the shade, the month and whether an account belongs to an artist working in makeup or hair. They are not linked to you, they never include client information or photographs, and they cannot be traced back to your account.

Artist Archive does not use identifiable client photographs or client records to train public artificial-intelligence models.

We do not use your client information to advertise to your clients or contact them directly.

7. Your responsibility for client information

Artist Archive allows you to store information about other people, including your clients.

You are responsible for the client information you enter into the app.

Allergy and sensitivity notes may reveal health-related information.

You should only record this information where it is reasonably necessary to provide your services and where you have appropriately informed the client or obtained consent when required.

Artist Archive does not provide medical advice and is not a substitute for checking allergies, sensitivities, contraindications or product suitability directly with your client.

You remain responsible for making professional decisions and following appropriate hygiene, safety and consultation practices.

Client photographs

Before uploading an identifiable client photograph, you must ensure that you have the right to store it for professional record-keeping purposes.

Permission to privately store a photograph is separate from permission to:

You are responsible for obtaining any additional consent required before publicly using or sharing a photograph.

Photo-consent feature

Artist Archive may allow you to record whether a client has agreed to public use of their photographs.

This is a record-keeping tool only.

Selecting a photo-consent option in the app does not itself obtain consent from the client or prove that legally valid consent was given.

You remain responsible for your own consultation, release and consent processes.

Client requests

If one of your clients asks to access, correct or delete information you have entered about them, you are generally responsible for responding to that request.

You can view, update and delete client information through the app.

Where reasonable technical assistance is needed, you may contact Artist Archive.

8. Privacy

Our Privacy Policy explains:

You must read the Privacy Policy before entering personal information into the app.

You are responsible for providing your own privacy information to your clients where required. Artist Archive’s Privacy Policy does not replace the privacy notice or policy for your own business.

9. Device permissions and connectivity

Some Artist Archive features may require access to your device’s:

You can change these permissions through your device settings. Some features may not function if the relevant permission is disabled.

Artist Archive does not automatically upload your entire photo library.

Certain actions, including signing in, synchronising records and uploading photographs, require an internet connection.

10. Free and paid features

Artist Archive is currently free to use, subject to any limits displayed in the app.

Free-use limits may include restrictions relating to:

Any applicable limit will be displayed in the app or on the Artist Archive website.

We may change the features or limits available on a free plan. Where a change would materially reduce an existing user’s access, we will take reasonable steps to provide advance notice where practicable.

Future paid features

We may introduce optional paid subscriptions or one-off purchases in the future.

Before charging you, we will clearly explain:

You will not be charged merely because you previously used a free version of Artist Archive.

You must actively choose to purchase a paid feature or subscription before a charge is made.

These Terms will be updated with the applicable payment and subscription provisions before paid features are launched.

11. App stores and payment platforms

If you download Artist Archive through Apple’s App Store, Google Play or another distribution platform, your use of that platform is also subject to its terms.

The app-store provider:

Where an app-store rule conflicts with these Terms, the app-store rule may apply to the extent required for your use of that platform.

Payment and subscription disputes relating to an app-store transaction may need to be raised directly with the relevant app-store provider.

12. Availability and changes to the service

We aim to provide a reliable service, but we do not guarantee that Artist Archive will always be available or operate without interruption or error.

You may need to install an update to continue using Artist Archive securely or to access particular features.

We are not required to support every device, operating-system version or app version indefinitely.

13. Records, backups and deletion

Artist Archive uses cloud storage so your records are not intended to be tied to a single device.

However, no digital storage service is completely risk-free.

You should keep a separate copy of any information or photograph that:

Artist Archive should not be your only copy of irreplaceable photographs or critical business records.

Deleting individual records

You can delete clients, sessions, notes and photographs through the app.

Once processed, deleted information will no longer be available through your active account.

Deletion may not be reversible.

Limited copies may remain temporarily in system backups, security records or provider infrastructure until they are removed or overwritten through ordinary retention processes.

Account deletion

You may delete your account through the app where the feature is available or contact us for assistance.

Deleting your account removes your active account and associated app content, subject to limited legal, security and backup retention described in the Privacy Policy.

Before deleting your account, you are responsible for saving any information that you are permitted to retain and wish to keep.

Failed uploads and unsaved information

We are not responsible for information that was never successfully received by our systems due to connectivity problems, device issues, incomplete uploads or failure to complete a save action.

This does not limit any responsibility we have for information that was successfully received but then lost because we failed to exercise the standard of care required by applicable law.

14. Intellectual property

Artist Archive and its licensors own all intellectual-property rights in the app and service, including rights relating to:

Except for the limited right to use the app granted under section 4, these Terms do not transfer any intellectual-property rights to you.

You may not use Artist Archive’s name, logos, screenshots or branding for commercial purposes without written permission.

This section does not affect your ownership of your content.

15. Suspension and account closure

You may stop using Artist Archive and delete your account at any time.

We may restrict, suspend or close your account where reasonably necessary because:

16. Inactive accounts

We may introduce an inactive-account policy in the future.

We will not delete an account solely because it has been inactive unless:

17. Third-party services and links

Artist Archive relies on third-party services, including cloud infrastructure, authentication providers, app stores, website providers and communication services.

We are responsible for selecting and managing our providers with reasonable care, but we do not control every aspect of their services.

Artist Archive may also contain links to third-party websites or services.

A link does not mean that Artist Archive owns, controls or endorses the third-party service.

Your use of a third-party service may be subject to that provider’s own terms and privacy policy.

We are not responsible for unrelated content, products or services offered by a third party.

18. Professional responsibility

Artist Archive is an organisational and record-keeping tool.

19. Consumer and business rights

Nothing in these Terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded, restricted or modified.

Consumer use

If you acquire the service as a consumer for purposes ordinarily considered personal or domestic, you may have rights under the Consumer Guarantees Act 1993 and other New Zealand consumer laws.

Those rights continue to apply to the extent required by law.

Business use

Artist Archive is intended primarily for professional and business use.

Then, to the extent permitted by law, you and Artist Archive agree to contract out of the Consumer Guarantees Act 1993.

To the extent legally permitted for a qualifying business-to-business transaction, the parties also agree to contract out of those provisions of the Fair Trading Act 1986 that the law expressly permits businesses to contract out of, where it is fair and reasonable to do so.

This section does not exclude obligations that cannot lawfully be excluded.

20. Warranties and service limitations

Subject to your rights under applicable law, Artist Archive is provided on an “as available” basis.

22. Ending the service

Artist Archive may stop operating the app or a significant part of it.

Where reasonably practicable, we will provide advance notice before permanently ending the service.

Where appropriate and technically possible, we will also provide a reasonable opportunity for active users to retrieve or export their information before the service closes.

Advance notice may not be possible where closure is required urgently because of:

When the service ends, your right to use the app will end and information will be handled in accordance with the Privacy Policy and applicable law.

23. Feedback and suggestions

You may choose to send us feedback, ideas or suggestions about Artist Archive.

You retain ownership of any original material contained in your feedback.

However, you give Artist Archive permission to use, adapt and implement your feedback without payment or obligation to you.

You should not send confidential business ideas or third-party material that you are not permitted to share.

24. Changes to these Terms

We may update these Terms where reasonably necessary because of:

Both you and Artist Archive agree to make a genuine effort to resolve the issue directly before beginning formal legal proceedings, unless urgent action is reasonably necessary.

26. Governing law

These Terms are governed by the laws of New Zealand.

Subject to any right that cannot legally be restricted, disputes relating to these Terms or the service will be dealt with by the courts or tribunals of New Zealand.

If the law in your country gives you a mandatory right to bring a claim in your place of residence, these Terms do not remove that right.

27. General provisions

Entire agreement

These Terms and any additional terms expressly presented for a particular paid feature form the agreement between you and Artist Archive regarding the service.

The Privacy Policy applies alongside this agreement as a notice explaining our handling of personal information.

Severability

If a court or other competent authority decides that part of these Terms is invalid or unenforceable, the remaining provisions will continue to apply.

The invalid provision will be interpreted or adjusted only to the minimum extent necessary to make it lawful and enforceable.

No waiver

If Artist Archive does not immediately enforce a provision of these Terms, that does not mean we have waived the right to enforce it later.

Assignment

You may not transfer your account or your rights under these Terms to another person without our written permission.

Artist Archive may transfer its rights and obligations to another operator as part of a sale, restructuring or transfer of the business, provided that doing so does not materially reduce your rights without appropriate notice.

No partnership or employment relationship

These Terms do not create an employment, partnership, agency, franchise or joint-venture relationship between you and Artist Archive.
